Because a Guilty Plea is Not Your Only Option

The state of Nebraska does not recognize expungements, per se. It is different if you have been convicted of a federal crime. In the Nebraska state system, an expungement is referred to as "setting aside" a conviction. This decision is made at the discretion of the sentencing court. You may have your conviction “set aside” if you completed probation satisfactorily and/or you paid your fine. If you served time for your sentence "unless as a part of your probation", you can not ask that your conviction be set aside. Other options include:

  • Pardon: Upon filing an application for pardon with the Nebraska state board of pardons, you may be able to receive a pardon. If you seek a pardon for a felony, current policy required that you must wait until ten years after your conviction or have completed your jail time, which ever is later. If it is for a misdemeanor, you must wait three years.
  • Mayoral Pardon: Most cities have their own laws. If you have been charged with a city ordinance violation, you may be able to receive a mayoral pardon. Reprieve of 15 Year License Revocation

If you have lost your license for a third or more DUI, you may very likely lose your license for fifteen years. If so, after seven years of your license revocation term, you can ask for a reprieve of your license revocation and if granted start driving again, legally. The final decision will be made by the board of pardons. You must display seven years of sobriety, a clean record, and no other reason for your license to be suspended in order to be considered eligible for reinstatement.
